Terms of Use

These Terms of Use govern your access to and use of Deep Dive Stream, including our websites, applications, streaming services, subscription offerings, rentals, account features, and related services (collectively, the "Service"). By creating an account, purchasing a subscription or rental, accessing content, or otherwise using the Service, you agree to these Terms and to our Privacy Notice.

If you do not agree to these Terms, do not use the Service. If you use the Service on behalf of a company, organization, or other entity, you represent that you have authority to bind that entity to these Terms.

You must be legally capable of entering into a binding agreement in your jurisdiction to create an account or purchase paid access. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring under your account. You agree to provide accurate information and to promptly update account information when it changes. You may not sell, transfer, or share account access in a manner that violates these Terms or circumvents access controls.

We may require account verification, payment verification, or other reasonable security measures to protect the Service, our users, and our licensors.

Deep Dive Stream may offer monthly, annual, promotional, trial, bundled, or other subscription plans. Available plans, prices, included features, and billing intervals are shown at checkout and may change from time to time for future billing periods, subject to applicable law and any notice requirements.

Unless otherwise stated at checkout, a paid subscription provides a limited, personal, non-transferable right to stream eligible subscription content while your subscription remains active. Subscription availability does not guarantee that any particular title will remain available for the entire duration of your subscription.

If your subscription is sold on an automatically renewing basis, you authorize us and our payment processor to charge the payment method on file at the beginning of each renewal period until you cancel. The renewal price and billing interval presented at checkout apply unless changed in accordance with applicable law.

You may cancel an automatically renewing subscription through the account or billing tools made available by Deep Dive Stream or through the platform through which you purchased the subscription. Unless otherwise required by law or expressly stated at the time of purchase, cancellation stops future renewals and does not retroactively refund charges already incurred.

If a payment is declined, reversed, disputed, or otherwise not successfully completed, we may suspend or terminate paid access until payment is resolved.

Some titles may be offered separately as rentals or other transactional purchases. The applicable price, viewing window, start time, expiration period, and other conditions are displayed before purchase. A rental grants only a limited right to view the selected title during the stated access period.

Starting playback may trigger or shorten a rental viewing window where stated at checkout. Expired rentals may require a new purchase. Except where required by law, completed digital rental purchases are generally non-refundable once access has been provided or playback has begun.

Deep Dive Stream curates independently produced, licensed, classic, restored, theatrical, and other audiovisual works. Content availability may vary by territory, subscription status, device, licensing window, and other factors.

We may add, remove, replace, edit, delay, or restrict access to titles at any time, including because of licensing terms, legal requirements, technical issues, quality-control concerns, or business decisions. We do not guarantee the continued availability of any title, collection, genre, feature, or catalog category.

Subject to your compliance with these Terms and payment of applicable fees, Deep Dive Stream grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial viewing only, unless we expressly agree otherwise in writing.

No ownership interest in any film, performance, score, artwork, software, trademark, restoration, metadata, or other content is transferred to you. All rights not expressly granted are reserved by Deep Dive Stream and its licensors.

You may not copy, capture, record, download except through an expressly authorized feature, reproduce, redistribute, publicly perform, rebroadcast, sell, sublicense, modify, create unauthorized derivative works from, or otherwise exploit content available through the Service.

You may not bypass or interfere with digital rights management, geographic restrictions, authentication, playback controls, security features, encryption, access limits, or other technical protections. You may not use bots, scrapers, automated tools, credential-stuffing methods, reverse engineering, or other techniques to access the Service in an unauthorized manner.

You may not use the Service for unlawful, fraudulent, abusive, infringing, or harmful activity, or in a way that disrupts the Service or other users.

Streaming quality depends on your device, browser, operating system, internet connection, network conditions, geographic location, content source, and other technical factors. Available resolution, audio format, subtitles, captions, and device compatibility may vary by title.

We may limit simultaneous streams, device registrations, geographic access, or other usage parameters to protect content and comply with licensing arrangements. We may update technical requirements from time to time.

The Service may save viewing progress, watch history, saved titles, search activity, preferences, and related account information to provide features such as Continue Watching, My List, recommendations, account history, and customer support.

These features are conveniences and may not always be complete, uninterrupted, or error-free. Our collection and use of personal information is described in the Deep Dive Stream Privacy Notice.

Deep Dive Stream may present independently produced films, licensed works, public-domain works, restored or newly presented editions, recorded stage productions, musicals, plays, live or delayed performances, and other specialty programming.

A Deep Dive Stream presentation, restored edition, collection, trailer, score, artwork, graphic package, subtitle file, commentary, introduction, or other added material may contain intellectual property owned by Deep Dive Stream or third parties even when the underlying motion picture or source work is in the public domain. Public-domain status of an underlying work does not grant permission to copy protected elements of a Deep Dive Stream edition.

Recorded theatrical and live-performance content may be subject to additional restrictions arising from performer, music, union, guild, venue, producer, territory, and underlying-rights agreements. Availability may therefore differ from film content and may change without notice.

The Service and its software, interfaces, branding, logos, graphics, design, collections, editorial material, trailers, original music, artwork, metadata, and other protected content are owned by or licensed to Deep Dive Stream and are protected by copyright, trademark, and other laws.

Deep Dive Stream, Deep Dive Restored Editions, and other Deep Dive names, marks, logos, and trade dress may not be used without prior written permission except as permitted by law.

We respect intellectual property rights. If you believe content available through the Service infringes your rights, contact us with sufficient information to identify the work, the allegedly infringing material, your contact information, and the basis of your claim.

Counsel should confirm the formal DMCA notice address, designated agent information, and any additional statutory notice procedures before final publication of these Terms.

The Service may rely on third-party providers for payment processing, hosting, authentication, analytics, content delivery, customer support, communications, and other functions. Your use of certain third-party services may also be governed by their terms and privacy policies.

Payment card information may be collected and processed directly by our payment processor rather than stored by Deep Dive Stream. We are not responsible for third-party services that are outside our control, except to the extent required by applicable law.

Promotions, free trials, discounted plans, bundles, gift access, referral programs, or special offers may be subject to additional terms. Eligibility may be limited, and we may modify or discontinue promotional programs consistent with applicable law.

We may suspend, restrict, or terminate access to the Service if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created security or legal risk, failed to pay amounts due, or used the Service in a manner that threatens our systems, users, licensors, or content partners.

You may stop using the Service at any time. Termination does not eliminate obligations that by their nature should survive termination, including payment obligations, intellectual-property protections, disclaimers, limitations of liability, indemnification, and dispute provisions.

We work to provide a reliable Service, but outages, maintenance, cybersecurity events, internet failures, content-delivery issues, software defects, and other interruptions may occur. We may update, modify, suspend, or discontinue features or portions of the Service.

To the fullest extent permitted by law, we do not guarantee uninterrupted availability, error-free operation, or compatibility with every device, network, or browser.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. DEEP DIVE STREAM DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LEGALLY BE DISCLAIMED.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded or limited under applicable consumer-protection law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DEEP DIVE STREAM AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICE.

COUNSEL SHOULD CONFIRM THE APPROPRIATE AGGREGATE LIABILITY CAP, ANY CARVE-OUTS, AND ANY STATE-SPECIFIC LIMITATIONS BEFORE THESE TERMS ARE APPROVED FOR PRODUCTION.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Deep Dive Stream and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and reasonable costs arising from your material violation of these Terms, unlawful use of the Service, or infringement of another person's rights.

The final version of these Terms should identify the governing law, forum, venue, and dispute-resolution procedure approved by Deep Dive Stream's counsel.

Counsel should specifically decide whether to include binding arbitration, an informal pre-dispute resolution process, a class-action waiver, small-claims exceptions, opt-out rights, mass-arbitration procedures, and any state-specific consumer disclosures. No arbitration or class-action waiver should be published until counsel approves the exact language.

We may update these Terms from time to time. When required by law, we will provide notice of material changes. The effective date displayed on this page identifies the version currently in effect. Continued use of the Service after revised Terms become effective constitutes acceptance to the extent permitted by law.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, acquisition, restructuring, financing, sale of assets, or similar transaction, subject to applicable law.

These Terms, together with the Privacy Notice and any additional terms presented for a particular transaction or feature, form the agreement governing your use of the Service.
